These terms of use (“Terms”) constitute a legally binding agreement between you and NORMS Restaurants, LLC (“NORMS Restaurant(s),” “we,” “us,” or “ours”) and govern your and other user’s (collectively “you,” “your,” or “users”) access to and use of NORMS Restaurant websites and services. While we do our best to enforce these Terms, we cannot warrant or represent that other users will in fact adhere to these Terms, and we cannot act as insurers or accept any liability for their failure to do so.

GENERAL USE RESTRICTIONS

All information, documents, products and services, trademarks, logos, graphics, and images (“Materials”) provided on this site are copyrighted or trademarked and are the property of NORMS Restaurant, LLC. Any unauthorized use of any material contained on the site may violate copyright laws, trademark laws, the laws of privacy and communications statutes.

NORMS Restaurant, LLC grants you the limited right to display the Materials only on your personal computer for your personal use. You agree not to use the materials for any other purpose without the prior written consent of NORMS Restaurant, LLC. Without limitation, you agree not to reproduce, re-distribute, sell, publish, broadcast or circulate any information contained in the materials to anyone, including others in the same company or organization. You may not post content from this site to news groups, mail lists, or bulletin boards. You acknowledge and agree that, except as set forth herein, you have no right to modify, edit, alter or enhance any of the materials in any manner. This limited license terminates automatically, without notice to you, if you breach any of these terms. Upon termination you agree to immediately destroy any printed or downloaded materials.

You agree not to “frame” or “mirror” any materials or third-party content contained on this site on any other server or internet-based device without the advanced written permission of NORMS Restaurant, LLC or its licensors, respectively. This site may be linked to other sites on the World Wide Web or Internet which are not under the control of or maintained by NORMS Restaurant, LLC. Such links do not constitute an endorsement by NORMS Restaurant, LLC. You acknowledge that NORMS Restaurant, LLC is providing these links to you only as a convenience.

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, NORMS Restaurant, LLC shall not be liable to you or any third-party claiming through you for any damage suffered as a result of your displaying, copying or downloading information or material contained on this site. In no event shall NORMS Restaurant, LLC be liable to you or any third-party for any indirect, extraordinary, exemplary, punitive, special, incidental or consequential damages (including loss of data, revenue, profits or other economic advantage) however arising, whether for breach or in tort even if NORMS Restaurant, LLC has previously advised of the possibility of such damage.

LOCAL LAWS

NORMS Restaurant, LLC controls and operates this site from its headquarters in the United States of America. If you use this site from outside the United States of America, you are entirely responsible for compliance with applicable local laws.

VIOLATION OF TERMS OF THIS SITE

If you violate the terms of this site, NORMS Restaurant, LLC reserves the right to terminate service to you without further notice or explanation. NORMS Restaurant, LLC’s preferred course of action is to advise you of your inappropriate behavior and advise you of any corrective action. You agree that NORMS Restaurant, LLC and its licensors may make improvements and/or changes in the services and prices described in this site, if any, at any time without notice, and further agree that NORMS Restaurant, LLC can revise these Terms at any time without notice by updating this posting. Your continued use of the site after such modifications have been made constitutes your acceptance of such revised Terms.

Any action related to these Terms will be governed by California Law and controlling U.S. Law without regard to the choice or conflicts of law provisions of any jurisdiction. You agree to the jurisdiction of the courts located in California for the resolution of all disputes arising from or related to these Terms and/or your use of the site. The failure of NORMS Restaurant, LLC to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by NORMS Restaurant, LLC in writing. The Terms comprises the entire agreement between you and NORMS Restaurant, LLC and supersede all prior or contemporaneous negotiations, discussions or agreements, if any, between the parties regarding the subject matter contained herein. Your use of the Site, however, is subject to the additional disclaimers and caveats that may appear throughout the site.

TRADEMARKS

“NORMS Restaurants” and “www.norms.com” are trademarks of NORMS Restaurant, LLC in the United States and other countries. Unauthorized use or duplication of these marks is strictly prohibited by law.

  1. General Terms and Conditions:

NORMS 24/7 Rewards Program (“Program” or “Loyalty Program”) is a promotional program offered by NORMS Restaurant, LLC. Under the Program, individual customers (hereinafter referred to as “you”, “your” or “Member”) can earn Loyalty Points (as hereafter defined) by making Qualifying Purchases (as defined below) via the methods specified by NORMS Restaurant, LLC (in NORMS Restaurants LLC’s sole discretion from time to time) at participating NORMS Restaurants locations in Southern California (“Participating Restaurants”) for “in-restaurant” and for Mobile App and Norms.com Qualifying Purchases (or any other check-in method for the Program offered by NORMS Restaurant, LLC from time to time). Your participation in this Program is subject to these Terms and Conditions (these “Terms”), including any and all changes made to these Terms in the future.

To Participate in the Program, you need to be a member and have a “NORMS Account”. If you are not already a member, you can join and establish a “NORMS Account” by downloading the NORMS 24/7 Rewards App from either the Google Play Store (Android) or the App Store (iOS) (or any other method offered by NORMS Restaurant, LLC from time to time) or by signing-up through your Facebook account. Simply follow the instructions you see on your preferred method for sign-up.

The Program and any and all of its terms and conditions is subject to cancellation and/or modification at any time without notice. You should not and may not rely upon the continued availability of the Program, the continued availability of any rewards offered under the Program, or any Loyalty Points accumulated in connection therewith.

With the Program you will receive credit of 1 point for each dollar you spend at Participating Restaurants for Qualifying Purchases for up to two (2) transactions per day which are made no sooner than 4 hours apart. Upon reaching 100 Loyalty Points you will earn $10 in Earned NORMS Rewards (offer subject to change for any reason at any time).

  1. Eligibility:

Participation in the Program is open to individual residents of the fifty (50) United States and the District of Columbia, who are age 18 years or older, and who have created a NORMS Account through the NORMS 24/7 Rewards App. The Program is not targeted towards and is not intended for use by anyone under the age of 18. The program is intended for personal use only by individual customers of NORMS Restaurant, LLC. Any and all commercial use is prohibited and not eligible.

  1. Participation:

Except as otherwise determined by NORMS Restaurant, LLC from time to time, to participate in the Program, you must have the NORMS 24/7 Rewards Mobile App and a NORMS Account. Limit: One (1) Account & Smart Device per person/email address, regardless of whether more than one (1) person uses the same email address or multiple Smart Devices. NORMS Restaurant, LLC may revise the methods in which a consumer can create an account at any time. During the time the Program is in effect (as determined by NORMS Restaurant, LLC in its sole discretion), when a member logs into his/her NORMS Account, you will be enrolled in the Program and your loyalty account (“Loyalty Account”) will automatically be established. You acknowledge and agree that NORMS Restaurant, LLC may send you information and notices regarding your Loyalty Account and the Program by email, push notification, or other means based on the information you provide. You acknowledge and agree that NORMS Restaurant, LLC shall have no liability associated with or arising from your failure to maintain accurate information, including but not limited to, your failure to receive critical information about the Program.

NORMS Restaurant, LLC reserves the right to deactivate any Loyalty Account that has not earned a Qualifying Purchase and/or has non-activity during a time period of 6 consecutive months.

  1. Earning Points:

With the Program you will receive credit of 1 point for each dollar you spend at Participating Restaurants for Qualifying Purchases, for up to two (2) transactions per day (24-hour period commencing at 12:01 am) which are made no sooner than 4 hours apart (“Loyalty Points”). You will only earn Loyalty Points on up to two (2) transactions every 24 – hour period regardless of the number of Qualifying Purchases made in such 24-hour period. Upon reaching 100 Loyalty Points you will earn $10 in Earned NORMS Rewards (offer subject to change for any reason at any time).

Food and beverage purchases designated by NORMS Restaurant, LLC. and made through your NORMS Account on the Mobile App or at Norms.com for in-store counter pickup or delivery may be deemed “Qualifying Purchases” and eligible for accrual of Loyalty Points. At any time without notice, NORMS Restaurant, LLC may add, eliminate, or otherwise change the food and beverage items that qualify as Qualifying Purchases. Except as may otherwise be determined by NORMS Restaurant, LLC., you must pay for your order for a purchase to be constitute a Qualifying Purchase. No partial Loyalty Points are awarded. For the avoidance of doubt, taxes and purchases of merchandise other than food and beverages, the use of charity donations, gift cards, and 3rd Party Delivery orders will not constitute Qualifying Purchases hereunder unless otherwise expressly designated by NORMS Restaurant, LLC.

Once you complete your Program enrollment, you will start earning Loyalty Points for Qualifying Purchases. After you check-in for a Qualifying Purchase, please allow up to forty-eight (48) hours for Loyalty Points to be deposited into your Loyalty Account. NORMS Restaurant, LLC will not be liable for any failure to credit Loyalty Points in a timely manner. You have a maximum of 72 hours after the date and time set forth on the receipt for such Qualifying Purchases to scan your receipt Barcode to earn Loyalty Points for in-restaurant purchases as further described below. Online and Mobile App purchases require account sign-in and Loyalty Points will be credited to your account within 48 hours from the time of pick-up.

NORMS Restaurant, LLC allows the earning of Loyalty Points by making in-restaurant purchases at Participating Restaurants. You will need to ask for your receipt for your in-store Qualifying Purchase at Participating Restaurants, which receipt will have a printed Program barcode (“Barcode”) at the bottom. To earn Loyalty Points on an in-store purchase: (i) make a Qualifying Purchase at a Participating Restaurant, (ii) open your Loyalty Account on the Mobile App, and (iii) digitally scan the Barcode using the Barcode scanning functionality in the Mobile App after giving the Mobile App permission to access your device’s camera functionality. You must scan the Barcode into your Account on the Mobile App within 72 hours after the date and time set forth on a receipt of your Qualifying Purchase associated with the Barcode, otherwise such Qualifying Purchase (and any potential corresponding Loyalty Points) shall be forfeited for purposes of the Program. Additionally, for the avoidance of doubt, you may only earn Points on up two (2) transactions per day (24-hour period commencing at 12:01 am) which are made no sooner than 4 hours apart, regardless of the number of Scans or when a receipt is scanned.

Barcodes are not transferrable between customers and may only be Scanned into the Account owned by the actual purchaser. Each Barcode may only be Scanned one (1) time. NORMS Restaurant, LLC reserves the right to limit the number of Barcode scans per person/Loyalty Account in its sole discretion. If NORMS Restaurant, LLC believes you have fraudulent, duplicitous, or unlawful Barcodes or Barcode scans, it reserves the right to remove any such Loyalty Points or Rewards from your Loyalty Account and/or terminate you from the Program.

  1. Surprise and Delight Rewards:

From time to time, you may receive rewards separate from Earned NORMS Rewards (a “Surprise Reward” such as a birthday reward, bonus points, or other benefit). The Surprise Rewards are not earned based on your Qualifying Purchases but granted at the sole discretion of NORMS Restaurant, LLC. Additionally, you may also receive additional benefits such as early notifications of new menu releases, special event invitations, and contests or sweepstakes separate and apart from the Program.

From time to time, NORMS Restaurant, LLC, or other third parties acting with NORMS Restaurant, LLC permission, may award additional points in the Program for certain types of Qualifying Purchases or for other reasons for a limited period of time (“Bonus Points). Bonus Points will contribute towards certain NORMS Rewards in NORMS Restaurant, LLC’s sole discretion. In such instances, Bonus Points will be awarded/redeemed as described in their separate promotional offer and will be subject to any additional terms set forth in such promotional offer.

  1. Points & Rewards Expiration/Forfeiture:

All NORMS Rewards will expire within Sixty (60) calendar days after the date that they were earned. For Example: You earned a NORMS Reward April 1, thus that Reward will expire on June 1st if you do not use the NORMS Reward prior to June 1. Your NORMS Rewards and Loyalty Points will be forfeited if your NORMS Account is terminated and/or deleted by you or NORMS Restaurant, LLC. You may not be provided with notice of expiration or forfeiture of Loyalty Points or NORMS Rewards. You are not entitled to compensation of any nature from NORMS Restaurant, LLC or from any other entity if your Loyalty Points or NORMS Rewards expire, are forfeited or if your NORMS Account is terminated for any reason.

  1. Account Standing/Status:

NORMS Restaurant, LLC reserves the right to deactivate and/or terminate any Loyalty Account that has not earned a Qualifying Purchase and /or has non-activity during a time period of 6 consecutive months.

In at any time your Loyalty Account is not in good standing, no additional Loyalty Points or NORMS Rewards may accrue with respect to any Qualifying Purchases you make until your Loyalty Account returns to good standing. Loyalty Points, Earned NORMS Rewards, Bonus Rewards and Surprise Rewards have no cash or other value and may be used only to obtain Earned NORMS Rewards at Participating Restaurants. Loyalty Points, Earned NORMS Rewards, Bonus Rewards and Surprise Rewards which accrue in your Loyalty Account do not constitute property and do not entitle a Member to a vested right or interest. Loyalty Points, Earned NORMS Rewards, Bonus Rewards and Surprise Rewards may be revoked, cancelled, limited, or modified at any time, even though such action may affect your right to use previously accumulated Loyalty Points, Earned NORMS Rewards, Bonus Rewards and Surprise Rewards. You may not purchase Loyalty Points, Earned NORMS Rewards, Bonus Rewards and Surprise Rewards or transfer Loyalty Points, Earned NORMS Rewards, Bonus Rewards and Surprise Rewards for one Loyalty Account to another Loyalty Account. You also may not transfer or sell any Loyalty Points, Earned NORMS Rewards, Bonus Rewards and Surprise Rewards of your Loyalty Account. NORMS Restaurant, LLC is not liable for Loyalty Points, Earned NORMS Rewards, Bonus Rewards and Surprise Rewards that are lost, suspended, delayed, uncredited, or revoked due to suspected or actual fraudulent, unauthorized, illegitimate, or other unacceptable use.

  1. Using Your Rewards:

When one hundred (100) Loyalty Points are earned within the timeframes set forth within, those 100 earned Loyalty Points will automatically convert to an Earned NORMS Reward, and the 100 Points will be deducted from your Loyalty Account and shall no longer be usable for reward redemption. For the current list and description of Earned NORMS Rewards, please review our FAQ section on your Mobile App. The amount of Loyalty Points to redeem Earned NORMS Reward(s) is determined by NORMS Restaurant, LLC and the selection and/or number of Loyalty Points needed to earn an Earned NORMS Reward may change from time to time without notice to you. All rewards under the Program are subject to availability and must be redeemed at a Participating Restaurant. Your Loyalty Points and all rewards under the Program will be forfeited if your Loyalty Account is terminated and/or deleted by you or by NORMS Restaurant, LLC.

For instructions on how to redeem your Earned NORMS Rewards, read the FAQs available on your Mobile App. Limit: One (1) Earned NORMS Reward per Transaction and the maximum reward dollar amount is $50. You may not combine any reward redemption under the Program with any other offers, discounts, or promotions. From time to time, NORMS Restaurant, LLC may limit the amount of rewards under the Program you can redeem within a specified period of time. Earned NORMS Rewards, Bonus Rewards and Surprise Rewards and Loyalty Points are not transferable, non-divisible, and may not be combined with other Member’s accounts. Any reward under the Program may be subject to terms and conditions specific to the reward as determined by NORMS Restaurant, LLC. You will be responsible for any cost(s) associated with any customizations, additions, modifications, or changes you make to any reward under the Program, including sales tax and gratuity. Unless, otherwise indicated, rewards under the Program earned through Qualifying Purchases must be redeemed within sixty (60) days of being posted to your Loyalty Account or they will be forfeited. Please see each reward’s expiration date in the Mobile App. NORMS Restaurant, LLC is not liable to you if a reward under the Program expired prior to your use of the said reward. Any reward under the Program which has expired will no longer be available for use or redemption. You can only acquire Earned NORMS Rewards to the extent that you have the required number of Loyalty Points in your Loyalty Account or to the extent NORMS Restaurant, LLC elects to offer any other reward method. You cannot combine Loyalty Points in one Loyalty Account with Loyalty Points in another Loyalty Account. Once a redemption order is placed or the reward under the Program expires, your Loyalty Account will show a deduction of said reward. Rewards are subject to availability at Participating Restaurants in California.

  1. SoCal Summer:

Scratcher cards available for distribution on August 9, 2023, through August 23, 2023, or when supply of cards is exhausted, whichever occurs first. VOID if reproduced, copied, altered, purchased, traded or sold and where prohibited and restricted by law. Prize(s) must be redeemed between, August 9, 2023 and September 9, 2023.
Scratcher card must be presented at the time of purchase to receive food or beverage prize. Food and beverage prizes valid for DINE-IN ONLY or TO-GO ONLY. Not valid on Third-Party Delivery, Catering or NORMS.com orders and may not be combined with any other coupon, discount or promotion. One-time use only.
**To claim Universal Studios Hollywood™ Tickets, $150 AMC Theatre© Movie Tickets, or $200 NORMS Certificate: Prize verification and a redemption form must be obtained from restaurant, completed and submitted before prizes can be processed. Must provide original scratcher card and prize form as proof of winning. Prizes will be shipped once prize redemption form is completed and received. All specific elements of the Universal Studios Hollywood™ Tickets or $150 AMC Theatre© Movie Tickets are at the sole discretion of the sponsor or Its designee(s). **$200 NORMS Certificate (Ten-$20 NORMS Certificates, only one certificate may be redeemed per visit) will be sent via US Mail.   1. Miscellaneous Loyalty Program Details:

You can view certain Loyalty Account activity on the Mobile App and only on the Mobile App. If your password or other proprietary information about your Loyalty Account is lost or stolen, please contact us at loyalty@norms.com. NORMS Restaurant, LLC is not responsible or liable for any Loyalty Points or rewards offered under the Program redeemed or used on your Loyalty Account through a lost or stolen password. If you have a problem or question regarding the Program or your Loyalty Account, send an email to loyalty@norms.com.

These Terms shall be binding upon and inure to the benefit of the parties hereto and their respective successors and assigns. If any provision of these Terms is held to be invalid or unenforceable, such provision should be modified or eliminated to the minimum extent necessary to allow enforceability and the remaining provisions shall be enforced. NORMS Restaurant, LLC reserves the right to terminate your access to and ability to participate in the Program (or any portion thereof), deactivate your Loyalty Account, and/or immediately invalidate all or any portion of your Loyalty Points and rewards under the Program for any reason and at any time in NORMS Restaurant, LLC’s sole discretion, including (without limitation) in the event of fraud, a violation of these Terms, or any other acts/omissions that NORMS Restaurant, LLC deems unacceptable (with or without notice). These rights are in addition to any other legal or equitable remedy that may be available to NORMS Restaurant, LLC under applicable law.

  1. Representations, Disclaimer of Warranties, and Limitations of Liability:

NORMS Restaurant, LLC and its parents, subsidiaries, officers, employees, and website contractors and each of their officers, employees, and agents (collectively, “NORMS Restaurant, LLC affiliates”) make no representation or warranty whatsoever regarding the completeness, accuracy, timeliness, or adequacy of any information, facts, views, opinions, statements, or recommendations contained on the platform. Reference to any product, process, publication, or service of any third party by trade name, domain name, trademark, service mark, logo, manufacturer, or otherwise does not constitute or imply its endorsement or recommendation by NORMS Restaurant, LLC or NORMS Restaurant, LLC affiliates. NORMS Restaurant, LLC and/or NORMS Restaurant, LLC affiliates are not responsible for any resulting damage to any user’s device or computer from any virus, bug, tampering, unauthorized intervention, fraud, error, omission, interruption, deletion, defect, delay in operation or transmission, computer line failure, or any other technical or other malfunction. You should also be aware that e-mail and other submissions over the internet may not be secure and you should consider this before e-mailing NORMS Restaurant, LLC or NORMS Restaurant, LLC affiliates. Any information or posting information to the platform. NORMS Restaurant, LLC or NORMS Restaurant, LLC affiliates make no representation or warranty whatsoever regarding the suitability, functionality, performance, availability, or operation of the platform. This platform may be temporarily unavailable due to maintenance, malfunction of computer equipment, or other reasons.

The platform (including all platform updates), the services, and the content are made available on an “as is,” “as available,” and “with all faults” basis. NORMS Restaurant, LLC and/ or NORMS Restaurant, LLC affiliates specifically disclaim all warranties, express or implied, including, without limitation, the warranties of merchantability, quality, fitness for a particular purpose, and non-infringement, with respect to the platform, the services, and the content. NORMS Restaurant, LLC does not warrant that the functions contained in or services performed, provided, or enabled by or through the platform (including any platform updates) will meet your requirements, that the operation of the platform, (including any platform updates) will be uninterrupted or error-free, or that defects in the platform (including any platform updates) will be corrected. No oral or written information or advice given by NORMS Restaurant, LLC or an authorized representative shall be deemed to alter this disclaimer of warranty, or to create any warranty. Should the platform prove defective, you assume the entire cost of all necessary servicing, repair or correction.

You agree that NORMS Restaurant, LLC and/or NORMS Restaurant, LLC affiliates are not liable to you for damages of any kind, whether based in tort, contract, strict liability, or otherwise, including, without limitation, any direct, special, indirect, incidental, consequential, or punitive damages (collectively, “damages”) resulting in any way from or in connection with: (I) the platform, the services, the content, messages, and/or any services performed through the platform or any failure of performance; (ii) any errors or omissions in the technical operation or content of the platform; (iii) any action taken in connection with an investigation by NORMS Restaurant, LLC, law enforcement, or other authorities regarding your use of the platform or the content or participation in any services; (iv) any action taken in connection with copyright owners; or (v) the conduct, actions, or inactions of platform users or your interactions or relationships with platform users, even if NORMS Restaurant, LLC, or NORMS Restaurant, LLC affiliates have been advised of the possibility of such damages, whether caused in whole or in part by negligence, acts of god, telecommunications failure, or theft or destruction of, or unauthorized access to, the platform or its related information or programs. Some jurisdictions do not allow the limitation or exclusion of certain warranties and conditions, or the disclaimer of some types of damages, so some of the above may not apply to you and the foregoing paragraph shall not apply to a resident of jersey to the extent damages to such new jersey resident are the result of NORMS Restaurant, LLC, negligent, fraudulent, or reckless act(s) or intentional misconduct.

The platform may contain facts, opinions, views, statements, and recommendations of third-party individuals and organizations. NORMS Restaurant, LLC, does not represent or endorse the accuracy, timeliness, or reliability of any facts, opinions, views, statements, or recommendations or other information displayed, uploaded, or distributed through the platform. You acknowledge that any reliance upon any such facts, opinions, views, statements, or recommendations is at your sole risk. In no event will NORMS Restaurant, LLC or NORMS Restaurant, LLC affiliates be liable to you or anyone else for loss or injury, including, without limitation, death or personal injury.

Some jurisdictions do not allow the limitation or exclusion of certain warranties and conditions, or the disclaimer of some types of damages, so some of the above may not apply to you.

  1. Mobile Services & Terms:

PLEASE READ THE FOLLOWING MOBILE TERMS CAREFULLY BEFORE USING THE NORMS RESTAURANT MOBILE SERVICES. THE “DISPUTE RESOLUTION” HEREIN SETS FORTH OUR ARBITRATION AGREEMENT, WHICH WILL, WITH LIMITED EXCEPTIONS, REQUIRE DISPUTES REGARDING THE MOBILE SERVICES TO BE SUBMITTED TO A BINDING AND FINAL ARBITRATION. UNLESS YOU OPT OUT OF THE ARBITRATION AGREEMENT: 1) YOU WILL ONLY BE PERMITTED TO PURSUE SUCH CLAIMS AND SEEK RELIEF AGAINST NORMS RESTAURANTS ON AN INIVIDUAL BASIS, AND NOT AS A PLAINTIFF IN ANY CLASS OR REPRESENTATIVE ACTION OR PROCEEDING; AND 2) ARE WAIVING YOUR RIGHT TO SEEK RELIEF IN A COURT OF LAW AND TO HAVE A JURY TRIAL ON YOUR CLAIMS. PLEASE SEE THE “DISPUTE RESOLUTION” SECTION FOR MORE INFORMATION REGARDING THIS ARBITRATION AGREEMENT, THE POSSIBLE EFFECTS OF THE ARBITRATION AGREEMENT, AND HOW TO OPT OUT OF THE ARBITRATION AGREEMENT.

This Section contains the terms and conditions (the “Mobile Terms”) for our mobile messaging services (the “Mobile Services”). By consenting to these Mobile Terms, you agree to receive recurring automated promotional and personalized marketing text (e.g., SMS, MMS, and RCS) and messages (e.g., cart reminders), as well as messages for transactional or relationship purposes from NORMS Restaurants, including text messages that may be sent using an automatic telephone dialing system technology, to the mobile telephone number you provided when signing up or any other number that you designate. You agree that you consent to receive such advertising or marketing messages regardless of any state or federal time of day restrictions and/or the presence of your telephone number on any state or federal Do Not Call list/registry. Consent to receive automated marketing text messages is not a condition of any purchase.

You understand that you do not have to sign up for the Mobile Services to make any purchases from NORMS, and your consent is not a condition of access to our goods or services, including purchases from NORMS Restaurants or any of our rewards programs. Your participation in the Mobile Services is completely voluntary.

Message frequency will vary. NORMS Restaurants reserves the right to alter the frequency of messages sent at any time, so as to increase or decrease the total number of sent messages. NORMS Restaurants also reserves the right to change the short code or phone number from which messages are sent, and we will notify you when we do so. You acknowledge that any messages, including STOP or HELP requests you send to a short code or phone number we have changed may not be received, and we will not be responsible for honoring requests made in such messages.

We do not charge for the Mobile Services, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply. Check your mobile plan and contact your provider for details. You are solely responsible for all charges related to SMS and/or text messages, including charges from your wireless provider.

NORMS may modify or cancel the Mobile Services or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time, and your continued use of the Mobile Services following the effective date of any such changes shall constitute your acceptance of such changes.

Not all mobile devices, handsets, or carriers may be supported, and our messages may not be deliverable in all areas. Messages may not be deliverable if you add digits or symbols to our phone number. NORMS Restaurants, its service providers and the mobile carriers supported by the program are not liable for delayed or undelivered messages.

To the extent applicable by law, you agree that we will not be held liable for failed, delayed, or misdirected delivery of any information sent through the Mobile Services, any errors in such information, and/or any action you may or may not take in reliance on the information or Mobile Services.

You agree to provide us with a valid phone number. If you get a new mobile number, you will need to sign up for the Mobile Services again with your new number. You also agree to our Privacy Policy. We may share certain information with our service providers as described in our Privacy Policy.

CANCELLATION OR HELP

You may opt out of the Mobile Services at any time. Text the keyword STOP, END, CANCEL, UNSUBSCRIBE, QUIT, REVOKE, or OPT OUT to our short code to cancel. After texting STOP, END, CANCEL, UNSUBSCRIBE, QUIT, REVOKE, or OPT OUT to our short code you will receive one additional message confirming that your request has been processed.

You acknowledge that our text message platform may not recognize and respond to unsubscribe requests that do not include the STOP, END, CANCEL, UNSUBSCRIBE, QUIT, REVOKE, or OPT OUT keyword commands and agree that NORMS Restaurants and its service providers will have no liability for failing to honor such requests. If you unsubscribe from one of our text message programs, you may continue to receive text messages from NORMS Restaurants through any other programs you have joined until you separately unsubscribe from those programs.

DISPUTE RESOLUTION

PLEASE READ THE FOLLOWING SECTION CAREFULLY. IT REQUIRES YOU TO ARBITRATE DISPUTES WITH US AND LMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF. THIS SECTION OF THE AGREEMENT SHALL BE REFERRED TO AS THE “ARBITRATION AGREEMENT.”

  • Scope. In the interest of resolving disputes between you and NORMS Restaurants in the most expedient and cost-effective manner, you and NORMS Restaurants agree that any dispute arising out of or in any way related to the Mobile Terms or your receipt of text messages from NORMS Restaurants or its service providers will be resolved by binding arbitration. Arbitration is less formal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, may allow for more limited discovery than in court, and can be subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award. This agreement to arbitrate disputes includes all claims arising out of or in any way related to the Mobile Terms, or your receipt of text messages from NORMS Restaurants or its service providers whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and regardless of when a claim arises. This Arbitration Agreement shall apply, without limitation, to all claims that arose or were asserted before the effective date of these Terms of Use.
  • YOU UNDERSTAND AND AGREE THAT, BY AGREEING TO THESE MOBILE TERMS, YOU AND NORMS RESTAURANTS WILL NOT PARTICIPATE IN OR SEEK TO RECOVER MONETARY OR OTHER RELIEF IN ANY SUCH CLASS, COLLECTIVE, AND/OR REPRESENTATIVE ACTION AND THAT THESE MOBILE TERMS SHALL BE SUBJECT TO AND GOVERNED BY THE FEDERAL ARBITRATION ACT. EACH PARTY MAY BRING A CLAIM AGAINST THE OTHER IN AN INDIVIDUAL ARBITRATION PROCEEDING. IF SUCCESSFUL ON SUCH CLAIMS, YOU COULD BE AWARDED MONEY OR OTHER RELIEF BY AN ARBITRATOR.
  • Informal Resolution. You and NORMS Restaurants agree that good-faith informal efforts to resolve disputes can often result in prompt, low-cost and mutually beneficial outcomes. You and NORMS Restaurants therefore agree that, before either you or NORMS Restaurants demands arbitration against the other, both parties will personally meet and confer, via telephone or video conference, in a good-faith effort to resolve informally any claim covered by this mutual Arbitration Agreement. If you are represented by counsel, your counsel may participate in the conference, but you shall also fully participate in the conference. The party initiating the claim must give notice to the other party in writing of their intent to initiate an informal dispute resolution conference, which shall occur within 60 days after the other party receives such notice, unless an extension is mutually agreed upon by the parties.
  • To notify NORMS Restaurants that you intend to initiate an informal dispute resolution conference, email ccparequests@norms.com, providing your username associated with your NORMS Restaurant account (if any), email associated with your NORMS Restaurant Account (if any), and a description of your claim. In the interval between the party receiving such notice and the informal dispute resolution conference, the parties shall be free to attempt to resolve the initiating party’s claims. Engaging in an informal dispute resolution conference is a requirement that must be fulfilled before commencing arbitration. The statute of limitation and any filing fee deadlines shall be tolled while the parties engage in the informal dispute resolution process required by this paragraph.
  • Arbitration Rules and Forum. This Arbitration Agreement is governed by the Federal Arbitration Act in all respects. To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim to our registered agent, 17904 Lakewood Blvd. Bellflower, CA 90706. The arbitration will be conducted by JAMS under its rules and pursuant to the terms of this Agreement. Disputes involving claims and counterclaims under $250,000, not inclusive of attorneys’ fees and interest, shall be subject to JAMS’s most current version of the Streamlined Arbitration Rules and procedures available at http://www.jamsadr.com/rules-streamlined-arbitration/; all other claims shall be subject to JAMS’s most current version of the Comprehensive Arbitration Rules and Procedures, available at http://www.jamsadr.com/rules-comprehensive-arbitration/. JAMS’s rules are also available at jamsadr.com (under the Rules/Clauses tab) or by calling JAMS at 800-352-5267. Payment of all filing, administration, and arbitration fees will be governed by JAMS’s rules. If the arbitrator finds that you cannot afford to pay JAMS’s filing, administrative, hearing and/or other fees and cannot obtain a waiver of fees from JAMS, we will pay them for you. In addition, we will reimburse all such JAMS’s filing, administrative, hearing and/or other fees for claims with an amount in controversy totaling less than $10,000. If JAMS is not available to arbitrate, the parties will select an alternative arbitral forum. You may choose to have the arbitration conducted by telephone, video conference, based on written submissions, or in person in the county where you live or at another mutually agreed location.
  • Arbitrator Powers. The arbitrator, and not any federal, state, or local court or agency, shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability or formation of this Arbitration Agreement including, but not limited to any claim that all or any part of this Arbitration Agreement is void or voidable. The arbitration will decide the rights and liabilities, if any, of you and NORMS. The arbitration proceeding will not be consolidated with any other matters or joined with any other proceedings or parties. The arbitrator will have the authority to grant motions dispositive of all or part of any claim or dispute. The arbitrator will have the authority to award monetary damages and to grant any non-monetary remedy or relief available to an individual under applicable law, the arbitral forum’s rules, and this Agreement (including this Arbitration Agreement). The arbitrator will issue a written statement of decision describing the essential findings and conclusions on which any award (or decision not to render an award) is based, including the calculation of any damages awarded. The arbitrator shall follow the applicable law. The arbitrator has the same authority to award relief on an individual basis that a judge in a court of law would have. The arbitrator’s decision is final and binding on you and NORMS.
  • Waiver of Jury Trial. YOU AND NORMS RESTAURANTS WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO DUE IN COURT AND RECEIVE A JUDGE OR JURY TRIAL. You and NORMS Restaurants are electing to have claims and disputes resolved by arbitration, except as specified in section (b), above. There is no judge or jury in arbitration, and a court review of an arbitration award is limited.
  • Waiver of Class or Consolidated Actions. YOU AND NORMS AGREE TO WAIVE ANY RIGHT TO RESOLVE CLAIMS WITHIN THE SCOPE OF THIS ARBITRATION AGREEMENT ON A CLASS, COLLECTIVE, OR REPRESENTATIVE BASIS. ALL CLAIMS AND DISPUTES WITHIN THE SCOPE OF THIS ARBITRATION AGREEMENT MUST BE ARBITRATED ON AN INDIVIDUAL BASIS AND NOT ON A CLASS BASIS. CLAIMS OF MORE THAN ONE CUSTOMER OR USER CANNOT BE ARBITRATED OR LITIGATED JOINTLY OR CONSOLIDATED WITH THOSE OF ANY OTHER CUSTOMER OR USER. If, however, this waiver of class or consolidated actions is deemed invalid or unenforceable with respect to a particular claim or dispute, neither you nor NORMS is entitled to arbitration of such claim or dispute. Instead, all such claims and disputes will then be resolved in a court as set forth in these Terms.
  • Batch Arbitrations. To increase efficiency of resolution, in the event of 100 or more similar arbitration demands against NORMS Restaurants, presented by or with the assistance of the same law firm or organization, are submitted to an arbitration provided selected in accordance with the rules described above within a 30-day period, the arbitration provider shall (i) group the arbitration demands into batches of no more than 100 demands per batch (plus, to the extent there are less than 100 arbitration demands leftover after the batching described above, a final batch consisting of the remaining demands); and (ii) provide for resolution of each batch as a single arbitration with one set of filing and administrative fees and one arbitrator assigned per batch. You agree to cooperate in good faith with NORMS Restaurants and the arbitration provider to implement such a batch approach to resolution and fees.
  • Opt Out. You may opt out of this Arbitration Agreement. If you do so, neither you nor NORMS Restaurant can force the other to arbitrate as a result of the Arbitration Agreement. To opt out, you must notify NORMS Restaurant in writing no later than 30 days after first becoming subject to the Arbitration Agreement. Your notice must include your name and address, your email address (if you have one), and a CLEAR statement that you want to opt out of this Arbitration Agreement. You must send your opt-out notice to ccparequests@norms.com. If you opt out of this Arbitration Agreement, all other parts of this Agreement will continue to apply to you. Opting out of this Arbitration Agreement has no effect on any other arbitration agreements that you may have entered into with us or may enter into in the future with us.
  • Survival. This Arbitration Agreement will survive any termination of your relationship with NORMS Restaurant.
  • Notwithstanding any provision in the Agreement to the contrary, we agree that if we make any future material change to this Arbitration Agreement, it will not apply to any individual claim(s) that you had already provided notice of to us.
